In response to California Senate Bill 1383 Surplus Edible Food Auditing services, KidCare International (KCI) is excited to partner with cities and businesses in the Inland Empire and Burrtec Waste to provide implementation of these required services. Adequate documentation and auditing of surplus edible foods is crucial for the success of the State’s Edible Food Recovery Program, helping to ensure that food is redirected to those in need while reducing organic waste and associated methane emissions.

Background: Senate Bill 1383 (SB 1383) is a California law aimed at reducing organic waste in landfills and combating climate change by cutting methane emissions. A key component of SB 1383 is the Edible Food Recovery Program, which focuses on recovering surplus edible food from businesses and redistributing it to people in need.

The main points include:

1. Target: By 2025, the goal is to recover 20% of edible food that would otherwise be disposed of.

2. Entities Involved: The law applies to “Tier 1” and “Tier 2” food generators, including supermarkets, grocery stores, food distributors, and large restaurants, who must establish contracts with food recovery organizations.

3. Implementation: Local governments are responsible for overseeing the program, ensuring compliance, and reporting progress to the state.

4. Education and Outreach: The program emphasizes public education about food recovery and proper disposal methods.

5. Penalties: Non-compliance can result in penalties for businesses and local jurisdictions.

The program addresses food insecurity and reduces greenhouse gas emissions by redirecting edible food from landfills to families and individuals in need.

KCI PROVIDES:

1. Record keeping, document requirements and reporting

• Food Generators: Businesses classified as Tier 1 (e.g., supermarkets, grocery stores) and Tier 2 (e.g., large restaurants, hotels with food facilities) must maintain records of the amount of surplus edible food they generate and donate.

KCI has established relationships with many of the Tier 1 and Tier 2 businesses in the Inland Empire. A list of these food generators that KCI will maintain records of surplus edible food are found in Exhibit 1.

• Contracts and Agreements: According to the bill, Food Generators need to establish written contracts or agreements with food recovery organizations or services that collect or receive surplus food. KIdCare International Food Recovery Program meets the necessary requirements for those contracts.

• Type and Quantity: Records should detail the types and quantities of food donated, the frequency of donations, and the dates of transactions.

• Recipient Information: Documentation must include information about the food recovery organizations or services receiving the donations, including contact details and capacities.

• Annual Reports: KIdCare International Food Recovery Program provides the necessary reports required as it partners with cities of the Inland Empire and Burrtec Waste, providing annual surplus waste information collected from Food Generators.

KCI provides “daily” and “as needed” food pick-ups for our partners.

KidCare International has provided edible food reclamation in the Inland Empire area since 1991. Currently our major food storage and distribution center location is Los Olivos Center in the City of Upland.

Food distribution takes place at KidCare International Food Bank Los Olivos in Upland on Saturday mornings regardless of rain, shine or holiday.

Emergency food is provided in “as needed” situations.
